1. This web site is in the business of providing information and advice to the horticultural and gardening industry especially the ornamental nursery sector. Anyone who uses this information ("the user") acknowledges that the owner(?) of the website ("the supplier') has no control over the use made of that information or advice.
2. The successful outcome of any horticultural crop is a result of many decisions made over the life of a crop, which can be up to two or more years for some ornamental crops and or garden plants. The decisions made will be influenced by past history, local growers, friends, advisors and other sources of information. Horticultural production, even in greenhouses, is subject to the risks of unforeseen weather and other natural phenomena and strongly subject to risks of unpredictable market conditions.
3. The supplier is not liable to the user for any loss or damage (including (but without limitation) any loss of profit, business, revenue, goodwill or anticipated savings) arising directly or indirectly in connection with:
- (a) this website; or
- (b) the information provided on this website ("the information"); or
- (c) the use, misuse or inability to make use of this website or the information.
This exclusion of liability applies to liability in contract and/or tort (including negligence) and/or under statute (to the extent that the parties can contract out of their statutory obligations), or any other principle of legal liability and applies to aggravated or punitive damages.
4. In the event that any limitation or provision contained in this agreement is invalid for any reason and the supplier becomes liable for loss or damage that would otherwise have been excluded, such liability is limited to the amount of the fee payable by the user to the supplier for the right to use this website or the information.
5. This website and the information are provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The supplier does not warrant that the functions or information contained in the website will meet the user's requirements or that the operation of the website will be uninterrupted or error free. The entire risk as to the quality and performance of the website, and/or the accuracy and completeness of the information is with the user. If the website or the information is defective, the user (and not the supplier or its authorised representative) assumes the entire cost of all consequences
6. The user agrees to indemnify the supplier against any and all claims resulting from or arising out of any use to which the website or information may be put by the user.
7. The information may be copied and reused provided it is accurately reproduced, the source is credited and in the event that it is passed onto third parties, the third parties agree to the terms of this agreement.
8. In relation to the liability of the supplier to the user and the use of the website and information, clauses 1 to 7 above contain the entire agreement between the supplier and user and supersede all prior agreements and/or understandings (oral or written) and any other communications between the user and the supplier relating to the website and the information.
